The aim is to provide compensatory remedies, not to punish them.
The person bringing the case is called the plaintiff/claimant, and the person accused of wrongdoing is called the defendant.
The burden of proof usually rests with the claimant.
The standard of proof means that the claimant must prove their case on the balance of probability.
